reason to buy dividend payers? let's say hipt cal we go over the fiscal cliff and dividend taxes go from 15% to 40%. does that take away my incentive and reason to buy a dividend payer? >> yeah. i would buy a stock you expect -- or a company you expect to be buying back shares next year because i expect capital gains tax, there will be a substantial difference between the two. >> it's a good point. andre, what's your take on that? do you think we'll see more buybacks as opposed to dividend payouts? who gets hit in the higher dividend tax? >> i think ron makes a really good point. when you come in and buy this stock back, obviously you're delivering the shares so that gives shareholders more profitability on their actual shares. so i think who really gets hurt are the companies buying these companies because they wanted that extra dividend. the price will drop down to where it was before the dividend was announced. unless you're a trader and trying to somehow be sneaky or cute and try to capture a little profit, you might be stuck with a stock that isn't worth owning. >> good analysi

causes. expectations were incredibly low last year. office max got put through the metaphor cal meat grinder. it was horrible. falling from $17 to $4. as the company came into 2012 the ball was set very low. when the expectations are that low, even lousy results can take the stock hire as long as they aren't downright pitiful. last year sales nowhere near good. but in line with the street's expectations and not absolutely hard which was good enough to give the stock some lift at these levels. even though max has rallied this year, it climbed from $17. it still has a way to go before it's back to even. when you look at it in that context, this rally doesn't seem insane. office max has been trying to get its house in order. it announced it was reinstating its two cent per share quarterly dividend. not much. the stock yields about 1%. it also told us it was conducting a comprehensive capital allocation review. designed to simplify its balance sheet. a couple of important elements here. office max got caught up in the terrible lehman bankruptcy. they had bonds backed by lehman connected

was. let me check michael ichaey cal. you see rank and file members of congress leaving the capitol. they are done for the week. they're headed back loam to their hometown districts. a lot of folks focused on this negotiation right now but the reality is that the negotiations are taking place among just a very few, very high level people. i was talking to a few rank and file members yesterday who said they were frustrated there is not a whole lot for them to do, they are just sitting around here waiting for some break-through in these negotiations. they want something to do on the floor, in their offices and there is not much for them to sink their teeth into. now they're going into their district. leadership is going to stay here and continue these negotiations. speaking of wasting, speaker of the house john boehner came out earlier today to say he's waiting, too, on a response from the white house to his proposal. take a listen. >> we need a response from the white house. we can't sit here and negotiate with ourselves. our targets and framework are things that we can all agree on
